O presente artigo apresenta as principais distinções feitas por Arendt em torno do seu conceito de ação, assim como debate as críticas a respeito da irrelevância do conceito de ação, e seu distanciamento da política real. As críticas ao conceito de ação política debatidas no artigo partiram de Jürgen Habermas e Martin Jay. O primeiro acusa Arendt de equiparar a ação estratégica à instrumental, e, portanto, situá-la fora do âmbito político, o segundo autor vai mais longe e acusa Arendt de (...) elaborar uma concepção tão heroica de ação que compartilharia uma das faces mais sinistras do totalitarismo, sua indiferença para com considerações utilitárias. Porém, tais interpretações não condizem com os textos de Arendt. Neles, ela não descarta elementos de intencionalidade e causalidade presentes em qualquer ação humana. (shrink)

Virginia Held nos propõe em seu capítulo “Care and Human Rights”, do livro Philosophical Foudantion of Human Rights, que utilizemos a perspectiva da ética do cuidado para pensar e efetivar as demandas que escolhemos tratar com a linguagem dos direitos humanos, na qual se prioriza tradicionalmente as questões da justiça. Ainda que reconheça a importância que os direitos humanos possuem em mobilizar forças tanto em âmbito internacional como na esfera nacional, no que diz respeito à efetivação de leis e de (...) políticas voltadas para problemas que afetam seriamente as populações dos países, Held frisa que milhares de pessoas ainda escapam a esse alcance, inclusive crianças, que morrem em número alarmante por desnutrição ou por doenças tratáveis. Destaca, ainda, que nossa concepção de direitos humanos é herdeira de uma visão individualista e violenta da tradição liberal, na qual o sujeito solitário vai enfrentar sozinho as forças do mundo, incluindo aí a natureza e as outras pessoas. Uma ética do cuidado, pela sua característica de reconhecer nossa situação necessária de vulnerabilidade e de interdependência, propõe-se como uma alternativa mais eficiente, por focar na relação entre cuidador/a e cuidado/a, buscando-se afastar das abstrações tradicionais como as que ela entende ser as demais abordagens éticas como a kantiana e a utilitarista, ainda tributárias daquela tradição liberal. This article originally advances the field of organizational whistleblowing by empirically investigating the suitability of the four elements of the fraud diamond as a means to understand the intention to disclose wrongdoing through virtual channels. This article also makes a contribution on the theme of whistleblowing as it relates to customers, an under-studied, however, relevant stakeholder in this field. The main findings of the article are as follows: the four elements of the fraud diamond as they relate to whistleblowing—a combination (...) of pressure, financial incentive, opportunity and rationalization, and capability—can explain the intentions behind customer reports of wrongdoing; online social media channels are customers’ preferred means of whistleblowing; the elements of opportunity and capability are strongly correlated with the use of social media as a method of disclosing wrongdoing; and virtual channels can be useful for whistleblowers in order to avoid potential retaliation. Unique managerial and academic implications of these research findings are also discussed, extending the layers of knowledge on whistleblowing in organizations. (shrink)

This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who worked (...) on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. This work empirically tests the concept of the ‘whistleblowing triangle,’ which is modeled on the three factors encapsulated by the fraud triangle (pressure or financial incentives, opportunity and rationalization), in the Indonesian context. Anchored in the proposition of an original research framework on the whistleblowing triangle and derived hypotheses, this work aims to expand the body of knowledge on this topic by providing empirical evidence. The sample used is taken from audit firms affiliated with both the big 4 and non-big (...) 4 companies operating in Indonesia. The results of analysis using the PLS-PM method found a significant relationship between the components of the whistleblowing triangle and the intention of blowing the whistle. We found that financial incentives are the most significant predictor of auditors’ intention to blow the whistle in Indonesia. Other components, such as opportunity and rationalization, also play an important role in supporting auditors’ intention to blow the whistle. Our findings also suggest that related pressures are the top priority for audit firms in Indonesia to consider in increasing whistleblowing intention. We expand the previous literature on whistleblowing which has been derived from the components of the fraud triangle (Brown et al. in Account Public Interest 16(1):28–56, 2016; Smaili and Arroyo in J Bus Ethics, 10.1007/s10551-017-3663-7, 2017) by adding empirical evidence. Academic leaders in management from all over the world—including recent calls by the Academy of Management Shaw (Academy of Management Journal 60(3): 819–822, 2017)—have urged further research into the extent and use of questionable research practices (QRPs). In order to provide empirical evidence on the topic of QRPs, this work presents two linked studies. Study 1 determines the level of use of QRPs based on self-admission rates and estimated prevalence among business scholars in Indonesia. It was determined that if the (...) level of QRP use identified in Study 1 was quite high, Study 2 would be conducted to follow-up on this result, and this was indeed the case. Study 2 examines the factors that encourage and discourage the use of QRPs in the sample analyzed. The main research findings are as follows: (a) in Study 1, we found the self-admission rates and estimated prevalence of business scholars’ involvement in QRPs to be quite high when compared with studies conducted in other countries and (b) in Study 2, we found pressure for publication from universities, fear of rejection of manuscripts, meeting the expectations of reviewers, and available rewards to be the main reasons for the use of QRPs in Indonesia, whereas (c) formal sanctions and prevention efforts are factors that discourage QRPs. Recommendations for stakeholders (in this case, reviewers, editors, funders, supervisors, chancellors and others) are also provided in order to reduce the use of QRPs. (shrink)

Utilizando-se do método fenomenológico, Scheler afirma que a ética deve basear-se na experiência, pois o valor não é algo que se atribui, mas que é experimentado. O fenomenólogo alemão defende que o homem está rodeado por um cosmos de valores que não necessita ser produzido, apenas reconhecido através do perceber sentimental, possibilitando, inclusive, uma organização hierárquica dos valores. No entanto, este perceber se encontra afetado (...) pelo ressentimento, o que implica em uma negação dos valores através da inversão valorativa. (shrink)

This paper is a research study of an interdisciplinary and exploratory kind drawing on a case study undertaken in elementary classrooms in socio-economically disadvantaged areas of Santiago de Chile. Having combined Linguistics for Education Studies and Corpus Linguistics approaches, the analysis of pragmalinguistic choices (i.e. personal pronouns, other lexical choices marking in-group relations) used in the introductory parts in a corpus of 50 lessons recorded in an elementary school setting there comes to be a key strategy for teachers' and learners' (...) involvement in classroom interaction The pragmalinguistic strategies evidenced in teachers' and learners' output have come to confirm the role of communicative strategies to promote participants' engagement in the teaching/learning process. In other words, teachers create an in-group relation, a solid sense of belonging and empathy among the participants in the teaching-learning context from the opening communicative stances in use to overcome less advantaged home and community cultural settings. The research findings also point to further studies to devise pedagogic tools addressing the specific contexts under scrutiny. Thus, a Teacher-Learner rapport is conveyed primarily through teachers' language choice, which is seen as the main force for learners' engagement in disadvantaged settings. (shrink)

ObjectiveThis study aims to analyze sociohistorically how the normative patterns of hegemonic masculinity produced impacts on men’s health/mental health in the context of the COVID-19 pandemic.MethodsA qualitative study from a socio-historical perspective was conducted with 50 men based on an online survey. A semistructured form was applied. The data were analyzed by the Collective Subject Discourse method, interpreted in the light of the context of epidemic disease and hegemonic masculinity.ResultsThe experience of the pandemic exposed the normative patterns of masculinities from (...) the consummation of acts representative of the pandemic context, which incited men to deny the existence of COVID-19 disease and to delay the understanding and adoption of measures to protect and control COVID-19. As a repercussion, men presented conflicts in the regulation of emotions; presented emotional suppression; were more reactive; felt threatened regarding the loss of the role of family provider, virility; and revealed a sense of invulnerability, added to the weakening of self-care.ConclusionThe discourse revealed that the men’s behaviors are consistent with the characteristics of hegemonic masculinity, but express signs of recognition that this behavior causes harm to themselves and their health. A critical analysis of Kelsen’s theory leads to a broad concept of custom, which covers diverse types of customary norms, where the always required conviction of legal bindingness depends on different types of factual and normative reasons. In it we should include a strict concept of custom or legal usage, derogating custom, custom of general international law, custom that establishes an unwritten constitution, custom that establishes a new written constitution, judicial custom which creates a rule of precedent and custom newly (...) expressed in the judicial application of customary rules. The basic norm could be formulated as a constitutive norm: ‘If the norms created through the first historical constitution are effective, then the first historical constitution are valid.’ It is thus a customary constitutive rule that recognizes the first historical constitution as valid law. Norms which establish sources of law are constitutive rules, they can be customary norms or legislated norms, but if they are legislated, they have their validity recognized by, directly or indirectly, a constitutive customary norm. By using a broad concept of custom as a conventional practice, Hart implies that general recognition of a customary rule, together with the practice that accompanies it, are sufficient conditions of validity. A doctrine of recognition that is arrived at by means of criticism and a rational reconstruction of the doctrines of Kelsen and Hart regains the essential theses of the traditional recognition theory of Bierling and Engisch. Este trabajo analiza los intentos llevados a cabo por Jeremy Bentham y John Stuart Mill para hacer converger algunos de los principales modelos de fundamentación moral: las éticas de la felicidad, como la aristotélica, o la propia ética utilitarista, las éticas del deber de raíz kantiana y las éticas de los derechos.Si conseguimos “reducir”, en primer lugar, las éticas de los derechos al modelo de la ética del deber, podremos simplificar mucho la cuestión y limitarnos a contrastar este último modelo (...) con las éticas de la felicidad, que a su vez deberían converger en la propia ética de la utilidad. No obstante, y aun reconociendo su gran interés, una convergencia completa entre modelos alternativos se revela como imposible. A pesar de los esfuerzos, sobre todo de John Stuart Mill, no es posible una unificación completa de los planteamientos utilitaristas con los de Aristóteles y Kant. La continuación de la empresa utilitarista de lucha por la unificación teórica en el ámbito del problema de la fundamentación moral encuentra un buen ejemplo actual en la obra de Esperanza Guisán. This paper aims to analyse a set of communicative events within the service encounter genre in tourism and leisure interdiscursive domains as displayed in course books on professional communication in English (commonly pointing to ESP). These supposedly replicate interaction in real life settings. Therefore, it is relevant to uncover the ways authentic interactions can be interpreted in the pedagogical setting of workplace conversation from a discursive and pragmatic perspective. More specifically, this empirical and exploratory study discusses ways of improving rapport (...) management skills in interpersonal and intercultural communication, in general, and in professional interaction, in particular, in a selection of excerpts on greeting / asking for info exchanges. The study uncovers participants’ possible co-constructions of civility and politeness strategies in naturally occurring classroom discourse supported by course materials in English for glocal communication across segments in the tourism domain as object of this study. Rawls says that public reason is the reason of the citizens of a democratic state and takes the Supreme Court in the USA as the exemplar of public reason. It differs from non public reason, which is used e.g., in universities and academic institutions. Rawls contrasts with Kant, which opposes the public reason of the scholar—or the philosopher—, who speaks before the world, to the private reason of state or church officials. The later, once they accept an authority, cannot think (...) by themselves (selbst denken). A closer examination shows that Rawls is not so far from Kant as it seems, because he takes the constitutional judges not as they are, but as they should be. However Rawls still apparently refuses Kant’s unity of reason. Further investigation of the relations between ethical reason, democratic reason and legal reason is needed. Democratic reason is tantamount both to public reason and to legal reason in a modern constitutional state. It is a requirement of ethics but still not identical with ethical reason, since it is possible to accept democratic reason and to argue against it from an ethical point of view. There is just one good way of reasoning, in spite of the constraints that the sources of law and the rules of procedure impose on legal reasoning, compared with ethics. Such constraints are based on the democratic principle, which is again based on ethical reason, which at last both grounds and limits the constraints that law imposes on reason. (shrink)

Does Duncan Kennedy successfully cannibalize jurisprudence? He attempts to do it by demonstrating the inexistence of rightness in legal argumentation. If there is no right legal argument, then there is no right answer in adjudication, adjudication is not a rational enterprise and legal doctrine cannot be said to be a science. It can be shown that skepticism is self-defeating. Duncan Kennedy can avoid self defeat only because he actually believes in a lot of legal arguments. His thesis that judges decide (...) questions of policy without any methodology that distinguishes them from legislators does not hold. Judicial reasoning is subject to constraints that do not affect legislators. It must be based on the sources of law and is limited by rules of procedure. Even when the judges have ‘interstitial’ legislative powers they are, unlike the legislator, bound to fit the system and their decisions are considered in procedure from the perspective of the right answer doctrine. The only work that can convincingly refute the skeptic argument against legal science is the reconstruction of jurisprudence as a scientific enterprise. Such work is beyond the scope of any single paper. The article aims to give some inspirations for such a task. (shrink)

Recorremos também às críticas dos filósofos Bennett e Hacker como pedras de toque da viabilidade de algumas teses. Desse modo, apresentamos uma revisão sistemática da obra de Damásio, Edelman e Searle, a fim de promover um diálogo produtivo entre as ideias defendidas por estes autores, os quais, segundo nossa interpretação, assumem uma teoria do (...) campo unificado da consciência. ABSTRACT Inspired by the concept used in the “tattoo scene” of blast over, which designates the use of spaces between tattoos to add others, without hiding or disguising the previous ones, we propose an exercise of analysis of an artist’s book, Coração com Estrela-do-mar Dentro [Heart with Starfish Inside] by Filipe Homem Fonseca (2019). The concept emerged from one of the pages of the book to become a target of questions of literary reading, from a pragmatic perspective as well. The (...) proposal will follow a route: enter the text through the book-object that gives an important place to the illustration, by death_by_pinscher, remove it from there and then include it again to make the global reading, in order to also enhance the appeal of the potential young reader to the text. The recent pandemic and consequent lockdown had a substantial impact on mental health and optimism regarding the future. Previous research showed that levels of depression, anxiety, and stress had increased throughout the pandemic. Nonetheless, how individuals cope when faced with adversity may be associated with positive expectations regarding the future. A sample of 274 Portuguese workers with a mean age of 40.86 and work experience of 19.68 years met inclusion criteria and agreed to participate in the proposed study. They represented (...) a variety of working classes. We investigated the associations between depression, stress, anxiety, adaptive and maladaptive coping, and optimism while controlling for working experience, gender, and work type. We found that depression was related to lower levels of optimism. However, for participants scoring high on adaptive coping and anxiety, higher scores of optimism were reported. Gender, work type, and experience did not significantly influence the results. These results provide evidence through which positive mental health can be promoted after the pandemic. (shrink)

As bibliotecas são também lugares de formação de mediadores informais de leitura literária. Este texto propõe um conceito que melhor ajude os que nelas trabalham a escolher as obras literárias que se leem e dão a ler: o design literário. Concentramo-nos nas obras que se reúnem no subsistema literário infantojuvenil (LIJ), em particular nos livros que subalternizam o código ver­bal, mantendo o valor que interessa para desenvolver o gosto e as competências para a leitura de literatura: é o livro-objeto, o (...) que desafia os limites da investigação em estudos literários, mas que julgamos importante para discutir a literariedade na sociedade contemporânea que se pretenda democrática no acesso à leitura literária para além do consumo de livros. Esta perspetiva pode ser considerada uma desvalorização do literário pela valorização do utilitário, o que contrariaremos. (shrink)

Whistleblowers who need to decide whether or not they should report wrongdoing usually experience several anxieties and pressures before making a final decision. As whistleblowers continue to attract the attention of a wide range of stakeholders, more research is necessary to understand the effects of the perceived seriousness of threats and perceived seriousness of wrongdoing, as well as the effect of the rationalization process on the intention to blow the whistle. We make the original proposal that the rationalization process can (...) affect how PST and PSW trigger whistleblowing intentions. We tested our model using employees of tax offices operating in an emerging economy. We suggest several research findings, which can be summarized as follows: PST reduces individuals’ intention to blow the whistle. That is, the greater the threat perceived by whistleblowers, the higher the likelihood they will choose to remain silent; we find evidence of a positive relationship between PSW and whistleblowing intention, whereby PSW increases individuals’ intention to blow the whistle. That is, the more serious the wrongdoing perceived by potential whistleblowers, the more likely they are to choose to blow the whistle; and we find evidence of the important role of rationalization in moderating the relationships between PST, PSW, and whistleblowing intention. The implications of these findings for business ethics scholars, managers, and end-users interested in whistleblowing are also presented. (shrink)

In September 2018, a controversial judicial sentence concerning sexual violence caused a public outcry in Portugal. The court decision invoked the alleged environment of mutual seduction, the use of much alcohol consumption, and the lack of serious injuries to justify the suspended penalty. Stemming from the idea that understandings of what journalism is and what it should be are profoundly ideological and that notions of what it means to be and to behave like a woman and as a man have (...) been developed based on shifting realities within generalised patriarchal structures, this article intends to critically analyse the news media coverage of the controversial judicial sentence on this rape case in Portugal exploring the implications objective-based journalism entails for gender equality. As such, it will identify the shortcomings of objectivity and its leeway when covering sexual violence exploring how objective-based journalism provides room to negotiate practices, norms, identities, and meanings concerning sexual violence, particularly rape and rape myths, and questioning whether a margin of maneuvre is enough to deconstruct patriarchal assumptions of feminity, masculinity and sexuality. Este artigo apresenta a potência do pensamento da filósofa e professora Ada Kroef para o ensino de Filosofia e a Educação. Para tanto, abordaremos os livros Currículo-nômade: sobrevoos de bruxas e travessias de piratas Inspirada pela Filosofia da Diferença (2018) e Escola como polo cultural: contornos mutantes em fronteiras fixas (2017). Nessas obras, a autora questiona teorias e práticas conservadoras do ensino e da educação de forma geral, propondo a criação de novas práticas e posicionamentos teóricos. Para tal, como método, usa-se a análise comparada de conteúdo das teorias e/ou dos trabalhos mais relevantes dos principais autores. As teorias podem dividir-se em dois grupos principais, adeptos e adversários da secularização. Enquanto os adeptos se afiguram como aprofundamentos e ajustamentos das teorias clássicas à realidade contemporânea, advogando sobretudo a religiosidade individual, os adversários apresentam concepções diferentes das (...) teorias clássicas da secularização, defendendo a permanência da religiosidade institucional. No primeiro grupo encontram-se as teorias pós-clássicas e as teorias da individualização, enquanto no segundo grupo apresentam-se o modelo económico, as teorias do regresso e as teorias histórico-culturais. Weber e Durkheim, e as correntes epistemológicas que representam, são a maior influência das várias teorias existentes, umas mais descendentes do primeiro, outras do segundo. O modelo económico distingue-se das restantes teorias por ser a única que não é influenciada por Weber e que é influenciada pelo empirismo anglo-saxónico. (shrink)
